Prior Lake Man Busted for Using Stolen Credit Card at Lakeville Restaurant

A Prior Lake man went hungry last week when he tried to order a pizza using a stolen credit card and showed up at his door instead

Garrett Devon Berry, 22, is charged with credit-card fraud, which carries a maximum penalty of five years in prison and a $10,000 fine.

He is also charged with a gross-misdemeanor count of providing a false name to a peace officer because, police say, when police asked his identity, he gave them someone else’s name – a man described in state records as 6-foot-2 and weighing 315 pounds.

According to the criminal complaint, Berry is 5-foot-4 and “weighs no more than 140 pounds.”

Berry remained in the Dakota County Jail Tuesday on a $5,000 bond. When he was arrested Nov. 1, police found two outstanding misdemeanor warrants on him, one for trespassing and one for failing to pay child support.

According to the complaint, Berry called in an order to the Lakeville Pizza Hut and provided a credit-card number to the store employee. When the employee ran the number, it came up marked “lost or stolen.”

The employee told Berry that the card had been declined, and he canceled the order. However, the employee called Lakeville police and provided Berry’s phone number and address.

When police arrived at Berry’s home, they encountered a group of people, and asked them who ordered the pizza. They identified “Garrett” as the caller.

Berry initially told police that he had gotten the credit card from his father, and he thought it belonged to his father’s girlfriend, according to the complaint. He turned over the card to an officer, who determined that it was stolen.

Berry identified himself as someone with the initials JLR, but when it turned out that he didn’t match JLR’s description, he admitted his real identity, the complaint says. He told the officer that he’d gotten the credit card from a friend, but didn’t know where his friend got it.

Berry’s criminal record includes a felony conviction for receiving stolen property in July.
