A man from New Germany, MN, has been charged with forcing a 15-year-old Lakeville girl to have sex with him earlier this week.

Darius Quamar Love, 18, is charged with felony third-degree criminal sexual conduct, which carries a maximum penalty of 15 years in prison and a $30,000 fine.

According to the criminal complaint, Love’s 15-year-old victim contacted Lakeville police Wednesday and told them she had just been assaulted.

The victim told police that she met Love July 30 at a nearby restaurant, and they exchanged phone numbers and agreed to meet July 31, but he didn’t show up.

They made arrangements to meet on Tuesday near a Lakeville park. The victim said she went to bed that night and was awakened at about 1 a.m. Aug. 3 by a text message from Love, telling her he was near the park and asking her to meet him.

The girl told police that they spent time “talking and cuddling,” then began consensually kissing. According to the complaint, Love pulled down the girl’s shirt, kissed her breasts and had other sexual contact with her.

“Love then violently pulled down the victim’s pants, shorts and underwear, and she immediately began telling him ‘no,’” the complaint says.

Love ignored her protests and continued to pursue sex with the victim, according to the complaint. The victim said he held her on the ground and tried to have sex with her while she continued to tell him “no” and “stop” and pushed and kicked him.

During the assault, Love put his forearm against the victim’s throat, causing her to gag and cough, the complaint says. At one point, according to the complaint, Love asked the victim, “How can you expect me to like you if you won’t do this?”

As the victim continued to struggle against Love’s advances, he stopped and said, “Maybe you shouldn’t have come,” then stood up and walked away, the complaint says.

When police arrived, they helped the victim initiate a text conversation with Love. During that conversation, Love told her he was sorry, according to the complaint.

“Why did you do that?” the victim asked via text message, and Love said again that he was sorry.

“You shouldn’t let a guy pull down your pants if you don’t want to have sex,” Love texted, according to the complaint. When the victim asked why he didn’t stop when she asked him to, he replied, “I can’t mess with you. You’re too young-minded,” the complaint says.

When police spoke to Love, he initially denied being in the park, telling them he was with another friend at the time and that he didn’t know the victim, the complaint says. When police confronted him with the text messages from the victim’s phone, he said he had met her, but in a different place.

When Love continued to deny the assault, police warned him about what DNA evidence might prove, at which point he admitted to kissing the victim and her breasts, as well as having other sexual contact with her, the complaint says. He claimed that she took her own pants off “and his pants came down,” according to the complaint.
