Lakeville Man Charged with Criminal Sexual Conduct

Daniel Alan Stewart, 49, is accused of sexually assaulting a woman last July.

A 49-year-old Lakeville man is accused of sexually assaulting a woman following a party at a Lakeville home last summer.

Daniel Alan Stewart has been charged with two counts of fourth-degree criminal sexual conduct. Each count is punishable by up to 10 years in jail and/or a fine of between $6,000 and $20,000.

According to a Dakota County criminal summons released last week:

The victim met with police on Aug. 10 to discuss the alleged assault, which reportedly occurred during the early-morning hours of July 1.

On June 30, the victim attended a party at a friend’s house, where she reportedly drank alcohol and smoked marijuana. Following the party, she went into a guest room, got ready for bed and went to sleep.

A short time later, she awoke when Stewart allegedly attempted to touch her inappropriately and to kiss her. She told him to stop, and he left the room. She fell back asleep.

She awoke twice more overnight when Stewart allegedly forced himself on her and performed sex acts. Each time, she reportedly told him “no” before she passed out.

When she woke up the next morning, she gathered her belongings and called a friend to pick her up. She allegedly told the friend what had happened. Later, she informed the host of the party about the alleged assaults. The host reportedly was upset and called her lawyer.

Following that conversation, the victim reportedly received a voice mail from Stewart, who accused her of making false accusations.

On July 2, the victim allegedly received another voice mail from Stewart in which he reportedly cried and apologized.

The victim reportedly showed police a conciliatory text message from Stewart dated July 1.

The victim told police she did not see a doctor after the alleged assault because she did not have insurance. 

Police interviewed the victim’s friend, who corroborated the victim’s account.

Stewart declined to make a statement police, the summons says.
